1.) Swamp Fox - 07/20/2017
A week or so ago there was a story going around, including video, of some guys fishing from the bank in a community park, confronted by vegan activists because [I]It's Not Food, It's Violence[/I]; [I]Fish Feel Pain[/I]; [I]You Wouldn't Do This To A Human Baby, Would You?[/I], etc.

There is video at the first link, and the two stories combined give a pretty complete picture.

Cops did nothing, and as far as I can tell it probably won't go anywhere despite the video. They might be looking into it further, but I've seen no evidence. Turns out Florida's law against hunter and fisherman harassment isn't that strong (I looked it up) and has a glaring and dumbfounding omission: it leaves private land completely out of the protection. There are some additional bizarrities in Florida that I won't get into here, but you get the idea.

So I was wondering: What's the situation with harassment and/or protections/enforcement where you are, for hunting, fishing, and trapping? Any weird rules about boating?

Florida, like New Hampshire, protects hunting and fishing by statute, but doesn't go as far as protecting them constitutionally. Twenty-one states guarantee the right to hunt and fish in their constitutions, with twenty of those approved via the voters. Vermont's provision was first in 1777, and the rest have passed since the mid-1990s: Alabama, Arkansas, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Minnesota, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, Tennessee, Texas, Virginia, Wisconsin and Wyoming.

Fishing is constitutionally protected in California and Rhode Island, but there is no such language in either state to protect hunting. Alaska apparently has strong-enough language in its constitution regarding wildlife and water use and a favorable history of case law that even though not explicitly protected, hunting, fishing and trapping seem on solid ground there. (I have not had a chance to look into trapping protections elsewhere.)

While explicit protection would be better, I would think that you could at least rely on trespassing statutes to cover private land incidents.

(f) This section does not apply to a peace officer of this state, a law enforcement officer of the United States, a member of the armed forces of the United States or of this state, or employees of the department or other state or federal agencies having statutory responsibility to manage wildlife or land during the time that the officer, member, or employee is in the actual discharge of official duties.
(g) A person who violates this section commits an offense. An offense under this section is a Class B misdemeanor.
(h) It is an affirmative defense to prosecution that the defendant's conduct is protected by the right to freedom of speech under the constitution of this state or the United States.[/quote]

Plus the constitutional protection you already mentioned. The penalty for violating the above statue is only a class C misdemeanor, but it's better than nothing. And of course, there's always, "Your Honor, I was in fear for my life." (I'm probably not being serious about that one, as far as you know.)

If that's not believable, you could always claim you were startled. Let's see how that works out in Minnesota. (LOL---:re:)

I thought of that, and come to find out that's what Fla. wildlife says would be the charge. Just trespass. But I don't understand why you would design the law that way. I can't believe trespass is any more vigorously pursued in Fla. than it is elsewhere, which is to say not very vigorously at all.

And why pass up the opportunity to layer another charge on top of trespass? Cops and prosecutors seem to have no problem piling up charges in any other kind of criminal case. Maybe they think it's harder to prove harassment, if an officer witnessing it is the only way they can think of, than it is to prove trespass by blocking a vehicle, catching someone on the property, etc.

But we don't need officers witnessing everything the law brings charges for. So why would we require it in these cases? (This also raises the question of whether or not Johnny Law is really "done" with the fishing case above, considering the video plainly shows harassment, at the very least with the confiscation of the fish.)

I think you're giving legislators far too much credit for logic, reason and being motivated by the desire to do what's right and/or makes sense. I suspect the simpler (and according to my good buddy Occam and his trusty razor, more likely to be correct) explanation is that there just hasn't been enough (or perhaps not any) lobbying pressure brought to bear on FL lawmakers to get them to pass such a set of statutes.

LOL...You're probably right. But think of it this way: You're up in Tallahassee and the strip clubs are all closed, but you're not ready to go to bed yet. You know you have to get this anti-harassment bill to the legislature by 10, so you stay up all night polishing what you've been "working on" for the last three years.

Just as the sun's coming up and you're thinking about whether to work a half-day or quit at lunchtime, you realize you haven't addressed harassment on private land at all. Remembering what your sainted dad told you---"Anything worth doing is worth doing right"--you say to yourself, "Screw it, it'll probably come up in committee" and climb in the shower, because you're already late for an early breakfast meeting with a real estate developer.

Yeah but let's get real. We had way bigger jerks around here than Kenny. Yeah, he was annoying and egotistical and a me monster and a one upper and a know-it-all.

But come on, other than those few character flaws, he was well received. There had to be more going on that I don't know about, than ventilator. Hell, back in the old days, I purposely was 1,000 times more annoying than him.

I know a few that have issues that had nothing to do with BULLZ-ear.

Just not that same anymore, very little useful info shared about hunting or archery. Not that you guys don't do the best you can amongst yourselves.


Anyway, I don't post much because there's little for me to add in discussions about things I don't know or care about. I'll be back with some scouting pics in a couple of weeks and maybe we can talk deer hunting. Or not.......it's all good either way.

I appreciate that. We actually do come up with topics all the time - Swampy more than others. We have talked about harnesses, climbing ropes, tree stands, various bow hanger options, field dressing etc. But I understand it someone wasn't here every day they would not "no" that.

There is a daily dose of humor which helps keeps us all sane.

I used to think our lurkers were the old guys, but couldn't figure out why they wouldn't participate. At this point I think I was wrong, unless there's something going on that I don't know about, but don't ask me why we almost always have between 20 and 50 lurkers (towards that upper end lately) but just the same small crew posting. I have no idea why we'd attract new lurkers but no new posters. I mean, I know the Joke Of The Day thread was a stroke of genius traffic-wise, but that can't explain all of it...LOL.

I'm gonna chime in here on this...just briefly.

I think its safe to say that most, if not all of us at one time or another has wondered about this issue and tried to figure it out. I agree with Luv2; I wonder also about the old guys. I know first hand from visiting with several of those guys that left pre 2010ish that often someone would get fired up at one or more of the others and hit their saturation point and then that was it. Unfortunately, there were some really good guys that left BC along with more than a few that needed to go...

Hey man, we are all human here...last time I checked, none of us knuckleheads walk on water. Obviously I've had my issues at times and even taken several extended walk-abouts from BC / HC over the years.

My theory is that participation mirrors the attitudes and behavior of our society. We are (generally speaking) more polarized than we've ever been politically, in general we seem to be acting less tolerant as well, not to mention less spiritual (again, I'm stating this in general, so don't anyone in particular get getting their panties in a wad)....So what does that get us? Well, for starters - not many people that are willing to stick around and put up with information or opinions that are contrary to their own beliefs. Then, on top of that, you got a percentage of folks that tend to be more serious and just want to stick to the topic at hand. There are several occasional members here that fit that bill, and that's fine. Just as it is fine to joke around and cut up...I agree with Blue on that, humor is a good thing, when not taken too far or too personally.

BUT, and here comes my big but in all this, and I've said it before, and I'll say it again...One issue I've seen on HC that has hurt participation in the past (just as it's created issues with untold numbers of people in all other venues of life) is when things get too 'Clicky' and exclusive. That tends to turn most folks off in a heart beat.

Then add in all the other potential minutia...and is it any wonder we're still not all running around clubbing each other on the head with sticks???

Not to mention that no one wants to be slammed by a bunch of know-it-alls either. As is so often the case; it's not always what one says, but how they say it.

And I don't claim perfection or all knowing on any of this. For example; I know that I royally, royally pissed Floyd off...even though I didn't mean to, and I'm still not sure just exactly what I did to do that....but I did.

It's all relative I guess. And the older I get the more I realize the less I know. Sure I might have some valuable knowledge to share, but if in doing that I turn someone away, then am I'm part of the problem or part of the solution? I think as rational adults we all need to consider these things. And taking that a step further, if turning people away from me (whether in person or on line) is what I am doing, then may be I need to reexamine my values. Because ultimately, I and only I am responsible for my actions. Its all a choice - I can choose to be a jerk, or I can choose to be a know-it-all or I can choose to be decent. I can choose to listen, or talk or I can chose to be an island to myself. Or I can choose to hide behind the mask of obscurity offered by the internet...and that opens up a whole another case of issues for some folks, but I'm not touching that one...

Well, that's my story and I'm sticking to it. So I'll shut up now.

Oh man, I just heard Spicy called it quits today... I'm gonna miss that guy.

Before something happened to that post, I was making a few points I’ll try to recreate more briefly this time around [Edit: Failed on that score]:

If the lurkers are not mostly the old crowd, I have no idea why they don’t participate, even on hunting/outdoors-related threads. I’ve put up a number of topics that I thought should generate discussion—and would have in the old days—that just went nowhere. A few that I thought were especially juicy got ZERO replies. (I can’t recall what the views were like. Modest, I want to say.) So what does that say if lurkers are the old crowd? What does it say if they’re new guys? I don’t think this place has horrible traffic for a small site that’s supposedly got nothing going on, so I don’t think non-participation is just the result of small numbers.

Along those lines, I’ve noticed that if you look at the number of views on various other threads here, we have some monsters. Considering the number of posters we have, it’s a bit of a mystery. And almost none of those threads are hunting-related. SOMEBODY’s interested in them…

The clique thing has come up a couple of times in these discussions, too, and I think there are a few problems with the argument that the feeling of a small, tight-knit club prevents people from posting.

First, the clique accusation has been around as long as this site’s been up, and by that I mean going back to at least 2000, with Archery World and then BowCountry and now HC. (Hope I haven’t forgotten any incarnations. LOL) People were talking about cliques when the site was rip-roaring. Most of them were joking. You know how I know?---They were in the clique! I’m sure some people didn’t feel like they were “in the inner circle,” but it was a BIG inner circle.

Feel free to argue with me about that, because if anyone *really* felt excluded or was treated unfairly, I’m unaware of it. And more to the point, cliques weren't preventing the site from having a lot of activity back in the heyday.

Secondly, the way to deal with a clique is not to take your ball and go home to suck your thumb. If you want to participate, you participate. That said, sometimes dealing with a clique isn’t worth the effort. Someone might feel they have nothing to add. Or there might be some personal conflict going on. To each his own. But choosing not to participate just because there’s a clique out there somewhere is a choice we make. Cliques are everywhere. They’re just part of life. It seems to miss the point to be aware of a clique (notice I didn’t say “complain about”) and act like a clique is like a shut-off valve to participation. No. It’s a *barrier*--- but the shutting off or turning on is on each individual.

Lastly, when you have a small group, you almost by definition have a clique. So here we are. :tap: It’s more than a little funny to hear people *complain* about a clique and use it as a justification for behavior (or non-behavior) that undermines expansion of the group. To quote our former president, “Let me be clear.” I’m not saying anyone who has brought this topic up is complaining. And just because you notice a clique doesn’t mean you’re trying to undermine anything. But walking away from a small group just because it’s a small group does say more about the walker than about the group.

I think the last point I was trying to make in the post that got wiped somehow was about the state of hunting forums in general these days. Basically, I said I bet I’m not the only one here who has to dig pages-deep into any other bow/hunting forum to find any topic of interest. Most of us are beyond the basic questions and numerous other categories of threads that show up on your typical forum. I was gonna say “dumb threads” but dumb is in the eye of the beholder and I’m sure somebody somewhere thinks any particular thread is dumb, even on HC. LOL. So that’s where the cut-and-paste of other forums’ front pages came from. I hope they made my point.

Seriously, I usually have to go at least four pages down on Archery Talk's bowhunting forum, say, to find something engaging, typically, if I’m even desperate enough to go over there in the first place. I’m sure that says something about me and my tastes and level of interest, but as fast as that place moves, it also says something about AT, and maybe about hunting forums in general.

And that’s all I’ve got to say about that!

My point is still valid. There are 3 regulars on here and a couple like me who chime in once in awhile. So everytime you start a discussion you're really only talking to DParker and bluecat.

And that is funny to me. Makes me wonder why you try so hard to talk to anyone else. They're not going to post, they never do. How or why we got here I'm not exactly sure. Maybe Forums are just running their course and everything is now done on Facebook and Twitter. I also wonder why Alex doesn't do anything to generate more discussion/interest.

I remember how you people would all fawn over him whenever he posted pics of half naked girls and giant pigs. You all acted like he was your long lost friend, like a bunch of suck-ups. If he posted more, others would post more, I'm sure of it.

I figured it out. When you click Auto Refresh you get a new screen (I thought it just flashed) and your options are hidden up at the top in plain view if you're looking for them. :bang:
